Alcohol Compliance Checks
In 2005 the Missouri General Assembly enacted legislation concerning the use of minors in alcohol investigations. The law became effective on August 28, 2005 and requires that specific guidelines be followed when using minors in undercover alcohol compliance check investigations.The statute can be found at Section 311.722, RSMo, and the corresponding regulation may be found at 11 CSR 70-2.280
The Division of Alcohol and Tobacco Control may administratively discipline licensees for violations that result from alcohol compliance checks conducted in accordance with RSMo 311.722 and 11 CSR 70-2.280. This is in addition to any summons issued to the clerk who makes an alcohol sale to a compliance check minor.
Law enforcement agencies should use the Alcohol Compliance Buy Checklist when conducting alcohol compliance checks within their jurisdiction.
If a local law enforcement agency conducts an alcohol compliance check in accordance with RSMo 311.722 and 11 CSR 70-2.280, the following documents are requested to be sent to the local district office for review for potential administrative action against the state liquor license.
- Copy of the law enforcement agency's investigative report
- Copy of the Minor Report (if the minor signed using their name, rather than using their CI #, redact the signature prior to submitting the document)
- Audio/video recording
- Copy of the minor's photo taken immediately prior to the operation
